1.1. The EV-NOVA service and associated application are the property of NOVA POWER & GAS SRL. All data collected through the application regarding the location and usage of charging stations belongs exclusively to NOVA POWER & GAS SRL. This data may not be used for any purposes other than the use of EV-NOVA services, nor may it be transferred or disclosed to third parties without consent.
1.2. EV-NOVA provides access to electric vehicle charging both on the customer's private charging points and at the public charging points included in EV-NOVA's network via the EV-NOVA app, which facilitates direct payment for the charging services.
1.3. The EV-NOVA app is available for download from the App Store or Google Play. Upon creating an account, the customer is required to accept these terms of service.
1.4. By downloading, accessing and using the EV-NOVA app, the customer acknowledges having been informed of these terms of service, accepts them and undertakes to observe them throughout. Failure to do so entitles EV-NOVA to refuse any future use of the app by that customer.
1.5. Registration and verification of payment cards are required for facilitating payments via the EV-NOVA app.
1.6. Payment for charging services is processed via the payment card registered by the customer. Customers may update their payment card information in their personal profile settings. All payment transactions are securely processed.
1.7. EV-NOVA reserves the right to conduct credit checks on customers in accordance with local financial regulations and data protection standards.
1.8. The use of EV-NOVA's charging services is strictly limited to the charging points that are part of EV-NOVA's network, as well as those included via our roaming partners.
1.9. Each payment transaction is recorded on the customer's account. The use of EV-NOVA charging services is deemed as the customer's acceptance of the charges and the conclusion of a purchase contract for charging services between the customer and EV-NOVA.
1.10. If the customer suspects any unauthorized use of the EV-NOVA services or their account, they must immediately contact EV-NOVA customer support to block the account and prevent misuse. In cases of theft or loss, EV-NOVA may require written confirmation and a formal report of the incident.
2.1. Customers are responsible for providing a compatible charging cable if required for use at EV-NOVA charging stations.
2.2. Charging stations are to be used in accordance with the applicable standards and regulations.
2.3. The charging capacity at EV-NOVA charging points may vary based on factors such as the electric vehicle's condition, battery level, and the charging station's capabilities.
2.4. Instructions for the use of charging stations are provided within the EV-NOVA app and, where applicable, at the charging point locations.
2.5. Charging stations provided by EV-NOVA are exclusively for the charging of electric vehicles.
2.6. When using charging points that are part of the EV-NOVA network, as well as those included via our roaming partners, customers must observe the following rules:
3.1. EV-NOVA charging services are designed to be available 24/7. However, accessibility to charging points may occasionally be limited due to maintenance, technical issues, or local restrictions such as parking rules.
3.2. EV-NOVA strives to ensure maximum functionality of our charging points. In the event of technical issues, we will endeavour to restore service as quickly as possible. Extended outages will be communicated via the EV-NOVA app.
3.3. EV-NOVA reserves the right to modify, suspend, or temporarily close the charging service or specific charging points for maintenance, updates, or due to circumstances beyond EV-NOVA's control, such as force majeure events.
4.1. Payments for the use of EV-NOVA charging services are facilitated through the registered payment card. Customers are billed monthly based on their actual usage, with itemized invoicing reflecting the pricing at the end of each month.
4.2. The customer is responsible for all charges incurred using EV-NOVA services. In the event of unauthorized use, the customer must promptly notify EV-NOVA to block the service and prevent further misuse.
4.3. Payments must be made by the due date as indicated on the invoice. Late payments may incur interest and additional fees as per applicable laws and regulations.
4.4. Failure to meet payment terms may result in the temporary suspension of EV-NOVA services to the customer.
5.1. Collection of customer data, including location information, is essential for the delivery of EV-NOVA services and is conducted in accordance with the GDPR and local privacy laws.
5.2. Customer data is used solely for the purpose of providing and improving EV-NOVA services. Customers have the right to request access to their data and to correct or delete their information as provided by law.
5.3. EV-NOVA commits to protecting customer data against unauthorized access and handling. Data related to charging history, such as charge points used, duration and costs, are kept confidential and are used for billing purposes and service improvements. Privacy policy
6.1. EV-NOVA is not liable for any incompatibility between the customer's electric vehicle and the charging stations or for indirect damages resulting from the use of EV-NOVA services.
6.2. EV-NOVA is not liable for damages resulting from improper use of the charging points and/or any damages suffered as a result of failing to observe the rules set out in the EV-NOVA terms of service.
6.3. Customers are responsible for ensuring that their electric vehicle is compatible with EV-NOVA charging points and adhering to all operational instructions provided by EV-NOVA.
6.4. EV-NOVA reserves the right to suspend services immediately in the event of misuse or where there is a risk of unsafe operation, and to claim compensation where such misuse results in damage to the charging points, whether direct or indirect, as well as for any other damage suffered by EV-NOVA as a result of that misuse.
7.1. EV-NOVA reserves the right to modify these terms of service. Customers will be notified of any significant changes within a reasonable time frame prior to the changes taking effect.
8.1. Force majeure is an unforeseeable event, outside the control of the parties, which cannot be avoided. EV-NOVA cannot be held liable for any error in the service offered through the app or in the provision of the services resulting directly or indirectly from causes outside its control.
8.2. This exemption includes, but is not limited to: errors and/or interruptions of any kind in the operation of technical equipment (for example charging points or the mobile app), failure of the internet connection, failure of telephone connections or other mobile devices, computer viruses, unauthorized access to EV-NOVA systems, operating errors, strikes, adverse weather conditions, pandemics and similar events.
8.3. Force majeure releases the parties from performing their obligations for the entire period during which it lasts.
9.1. These terms and conditions are governed by the laws of Romania. Any disputes arising from these terms will first be settled amicably and, where that is not possible, resolved by the competent Romanian courts.
