Nova Power & Gas SRL (NOVA) understands the importance of your personal data and is committed to protecting its confidentiality and security. It is therefore important for us to provide you, in an integrated and practical manner, with information about the processing of your personal data as a data subject (customers/employees, potential customers/employees, users of the NOVA websites — including ev-nova.ro — and of the EV-NOVA app, users of the online CRM platform) in this Personal Data Processing Policy, applicable for the purposes set out below.
NOVA securely administers the personal data you provide about yourself, and only for the specified purposes, in the context of purchasing our products and services and/or visiting the NOVA website and the online CRM platform.
Providing electricity/natural gas, natural gas distribution, electric vehicle charging services, and other associated services or products of NOVA.
In most cases, we process your personal data for activities related to the supply of electricity/natural gas and to natural gas distribution, including connecting you to the natural gas distribution network. The data we process include: name and surname, identity document details, home address, correspondence address, consumption location address, phone number (landline and mobile), email address, customer code, consumption location code, property document details, topographic data of your properties, bank account information, signature, electricity/natural gas consumption data (actual and forecast), invoice number and series, issue date, due date and billing period, billed products and services, billed quantity, average daily consumption, meter reading period, meter type and series, balance situation, invoice total, as well as other data included in the electricity/natural gas invoice.
The basis for processing the above data is the conclusion and execution of the electricity/natural gas supply contract, as well as the conclusion and execution of the natural gas distribution network connection contract.
Transmission of offers at your request
If you request offers regarding our products and services, your data will be processed in order to conclude a contract with you, at your request, should our offer be of interest. Processed data include: name and surname, identity document details, correspondence address, phone number, email address, and the consumption location address and code where applicable.
Transmission of offers on our initiative, following your agreement or our legitimate interests
If you have agreed to receive communications about NOVA's products, services and promotions, we will process certain personal data in order to send you such information. Processed data include: name and surname, phone number, email address. In this case, the basis for processing is your consent.
The use of your information is also necessary for us to build our business and offer you our services. We consider and balance any potential impact on you and your rights before processing your personal data for our legitimate interests. When communicating with you about our services, we may contact you regarding NOVA news, product updates and new products we believe may interest you. In this case, the basis for processing is our legitimate interest. You can opt out at any time by emailing protectiadatelor@novapg.ro.
Transmission of information to public authorities, as required by law
In certain situations the law requires us to communicate customer data to particular authorities, such as the National Energy Regulatory Authority (ANRE), and to store customer data for a defined period. In this case, the basis for processing is compliance with a legal obligation.
Defending our rights and interests or those of others
We may process your data in order to exercise or defend our rights or interests, or those of others, before the courts, judicial enforcement officers, notaries or other public authorities, lawyers and our consultants involved in those disputes or negotiations. In this case your data are processed, as applicable, on the basis of compliance with legal obligations or of our legitimate interests.
Personal data subject to special protection, such as the personal numeric code and the series and number of the identity document, will be collected and processed under restrictive conditions and in accordance with the applicable legal provisions.
Providing personal data is necessary for NOVA to carry out the activities described above. A refusal to provide these data may make it impossible for us to supply our products and services, to respond to your requests, or to carry out any of the other activities mentioned above.
In order to achieve one or more of the purposes mentioned above, NOVA may disclose your personal data to the following categories of recipients: our contractual partners, but only under a confidentiality commitment on their part, including service providers (marketing, courier, payment or banking services) and entities assisting NOVA in data processing as processors, insurers, public authorities (the Prosecutor's Office, the Police, the courts and other authorized state institutions), on the basis of and within the limits of legal provisions, other companies in the same group as NOVA (E-INFRA), as well as to you as the data subject in the context of exercising the rights granted by Regulation (EU) 2016/679.
Your personal data are processed for the entire duration of the contract, until contractual obligations and archiving periods expire, in accordance with the legal provisions. Your data are also processed until you withdraw your consent, provided there is no other legal ground allowing us to continue processing.
At present we do not transfer, and do not intend to transfer, your personal data to entities in third countries or to international organizations. Should such a transfer become necessary, we will inform you in advance and, where applicable, ask for your consent.

An email requesting the exercise of a right will not be interpreted as consent to the processing of your data beyond what is necessary to handle that request. Such a request should clearly state which right you wish to exercise and the reasons, where these are required. The request must be signed and dated and accompanied by a scanned copy of your valid identity document.
NOVA will promptly confirm that we have received your request. If the request proves well-founded, we will honour it as soon as possible and no later than 30 days from receipt.
If you believe that one of your rights has been infringed, you may contact the National Supervisory Authority for Personal Data Processing (ANSPDCP).
NOVA does not seek to process the personal data of minors in its activities and does not carry out direct marketing aimed at minors. Anyone providing us with personal data warrants that they are of age and have full legal capacity. Any processing of minors' data will be carried out solely in accordance with the law.
We guarantee that your personal data are kept secure. NOVA will take appropriate technical and organizational measures to keep the data protected against unauthorized access or theft, as well as accidental loss, alteration or destruction. Access by NOVA staff will be granted strictly on a need-to-know basis and subject to strict confidentiality obligations. Nevertheless, safety and security are due diligence obligations that can never be fully guaranteed.
When you receive messages from email addresses on the novapg.ro subdomain, or reply to or send messages to such addresses, please be aware that both the content of those messages and the details of the communication (name, surname, position, email, phone, data from your electronic signature) may be shared internally with other entities in the group to which NOVA belongs, as well as with NOVA's directors, employees, agents or authorized representatives.
